General Terms and Conditions
An overview of the most important points for those in a hurry
- After booking a rental car package online, please check your booking documents, the voucher and the invoice - let us know of any inaccuracies as soon as possible so that we can correct the documents promptly.
- Please make sure you take the voucher with you when you pick up your rental car. The rental car cannot be handed over without the voucher.
- Please read the terms and conditions and additional rental agreement documents of the local rental car provider carefully before signing them - write to us if there is anything you do not understand! The terms and conditions and additional rental agreement documents of the local rental company may contain further rules for the rental relationship that you need to know before you sign.
- Inspect the rental car thoroughly before you take it from the rental car provider.
- Report any damage/defects to the rental car immediately to the local rental car provider. Make sure that the rental company records any damage/defects before taking over the vehicle.
- Take all the necessary documents, papers (such as driving licence) and credit cards with you when you pick up the vehicle. If you have an additional driver, please also take them with you when you pick up the vehicle.
- Observe the return time and other requirements of the local rental car provider.
- Please read the following Planet Rentalcars General Terms and Conditions carefully.
I. Provider, scope of application, contractual language
- Planet Rentalcars is a service of AurumCars GmbH, Erika-Mann-Str. 62-66, 80636 Munich, Germany (hereinafter: Planet Rentalcars).
- These General Terms and Conditions (hereinafter: GTC) apply to all services that Planet Rentalcars makes available to the customer directly or indirectly, via the Internet, by email or by telephone, regardless of the end device (e.g. PC, mobile phone, tablet) and which of the associated domains the customer uses to access the services of Planet Rentalcars.
- The GTC apply exclusively. Pre-formulated terms and conditions of the customer which deviate from or contradict these GTCs do not become part of the contract, even if they are known, unless Planet Rentalcars expressly agrees to their validity in writing.
- The contractual language is English.
II. Subject matter of the contract, booking, contract text storage
- Planet Rentalcars offers customers the booking of various car hire packages via various sales platforms on the Internet. In addition to the rental of vehicles, Planet Rentalcars ' offer also includes advising customers on the selection of the right hire car, smooth booking processing, the inclusion of comprehensive insurance cover during the rental period and the provision of additional, relevant information about the rental destination.
- The car hire offers presented on the Planet Rentalcars website, whether they are labelled as ‘immediately available’ or ‘on request’, do not constitute offers to conclude a contract in the legal sense, but are to be understood as an invitation to the customer to submit legally binding offers to Planet Rentalcars. Planet Rentalcars and the customer are the contracting parties to the rental contract, including any additional advisory services that may be included. By sending the booking details to Planet Rentalcars, in particular the rental location, the rental period, the desired vehicle category and additional equipment, the customer submits a legally binding offer to Planet Rentalcars to conclude a rental contract. Planet Rentalcars accepts the customer's offer by sending a car hire voucher and a confirmation of the booking corresponding to the voucher in text form (e.g. by email) (= conclusion of contract). The customer receives the confirmation immediately for ‘immediately available’ car hire packages and within a maximum of 72 hours of sending the booking details for ‘on request’ car hire packages. If the customer does not receive such a confirmation from Planet Rentalcars within 72 hours of sending the booking details, they are no longer bound by their booking request and any payments already made will be refunded immediately.
- The customer is requested to complete the mandatory fields in the booking form carefully, in particular the personal details, contact details such as e-mail address and payment details. Incorrect information can lead to errors in the rental contract, for which the customer is then responsible. The customer is requested to check the submitted contract documents, in particular the car hire voucher and the invoice, carefully and immediately upon receipt and to notify Planet Rentalcars immediately of any inaccuracies or incompleteness.
- The text of the contract is stored by Planet Rentalcars for a limited period of time and can no longer be accessed by the customer on the Internet after the booking has been sent. The data will be deleted after the expiry of tax and commercial law regulations. In his own interest, the customer is requested to save a printout or permanent storage of the contract text and the booking data.
III. Prices, terms of payment
- The prices quoted are so-called total prices and include all taxes and other price components. The prices are quoted in British pounds, unless another currency is expressly stated in individual cases.
- The prices quoted are based on a rental period that is generally calculated on a 24-hour basis from the time the vehicle is picked up. If the customer does not fully utilize the 24 hours of the last unit of the rental period, the agreed price for this last 24-hour unit will still be charged in full. The total price of the booking is valid for the confirmed period.
- If the customer returns the rental car late to the vehicle fleet provider, the latter's regulations and local tariffs apply, over which Planet Rentalcars has no influence. Any additional costs incurred as a result shall be borne by the customer. If the vehicle fleet provider charges Planet Rentalcars for these additional costs, the customer shall indemnify Planet Rentalcars against them.
- Costs, taxes and fees for services that the customer additionally books with the vehicle fleet provider on site are not included in the prices quoted by Planet Rentalcars and must be borne by the customer in addition. The customer is expressly not authorized to enter into agreements for additional services in the name and for the account of Planet Rentalcars.
- The total price of the booking is payable in two ways:
- I. Full payment upon booking: The total price of the booking will be debited from the customers credit card or PayPal account immediately after the conclusion of the contract. The direct debit is made upon receipt of the booking confirmation from Planet Rentalcars and is carried out using the identifiers ‘Planet Rentalcars’ or ‘AurumCars’. Please note that, as a rule, the customer must present a credit card when picking up the rental car, unless expressly stated otherwise.
- II. Payment in instalments on booking:With this option, the booking price is paid in two instalments. A deposit will be debited from customers credit card or PayPal account immediately after the contract has been concluded and will be made using the identifiers ‘Planet Rentalcars’ or ‘AurumCars’. Even if payment for the booking is not processed in full via Planet Rentalcars, Planet Rentalcars remains the sole organiser and provider of the car rental service. If customer cancels the booking up to 24 hours before pick-up, the deposit will be refunded in full. The final payment will be made when you pick up the rental car from the vehicle fleet provider on site and will be debited from the means of payment used by the customer on site, quoting the vehicle fleet provider's identification number. The final payment is made in the name and on behalf of Planet Rentalcars. Please note that, as a rule, customer must present a credit card when picking up the rental car, unless expressly stated otherwise.
IV. Subsequent price changes
- All prices (section III) are valid at the time of their enquiry. Price changes or amendments to these GTC are possible at any time for booking enquiries from the customer that have not yet been accepted by Planet Rentalcars by sending a car hire voucher and a booking confirmation and represent a new offer from Planet Rentalcars to the customer.
- Planet Rentalcars cannot practically exclude the possibility that in the period between the conclusion of the contract (see Section II) and the actual start of the rental, the price may be increased by the vehicle fleet provider, in particular due to an increase in taxes or fees, which Planet Rentalcars cannot foresee or influence at the time of booking. This applies in particular in the event of insolvency of the vehicle fleet provider.
- Planet Rentalcars reserves the right to charge the customer the difference in these rare cases.
- If Planet Rentalcars makes use of this right, the customer will receive information from Planet Rentalcars about the increase in the booking price using the contact details provided by the customer. The customer then has the right to cancel the rental contract with Planet Rentalcars within two weeks, but no later than 24 hours before the start of the rental, in text form (e.g. by email to: email@planetrentalcars.com).
- In such a case, the customer cannot make any further claims against Planet Rentalcars.
V. Vehicle handover, notification of defects, handover protocol
- Planet Rentalcars cooperates with selected car hire providers worldwide in order to be able to provide the customer with appropriate car hire capacities at the desired destinations. The customer is obliged to present the car hire voucher provided by Planet Rentalcars to the car hire provider for vehicle handover. Without presentation of the car hire voucher, the car hire provider is not obliged to hand over the car hire to the customer at the conditions booked with Planet Rentalcars.
- The pick-up time booked and stated on the car hire voucher is binding. Experience has shown that the car hire providers keep the vehicles available for pick-up for a further 30-60 minutes after the pick-up time stated on the car hire voucher has expired; the customer is not entitled to this. After the agreed pick-up time has expired, the car hire provider is authorised to assign the vehicle to another party. In cases of vehicle pick-up outside of regular opening hours, an additional fee may be charged on site, which must be paid by the customer directly to the car hire provider.
- Planet Rentalcars accepts no responsibility for cases in which the car hire provider refuses to return the vehicle for reasons relating to the customer, whether psychological, physical or other impediments such as inability to drive due to alcohol or drug consumption, non-compliance with minimum or maximum age limits, missing documents or the carrying of invalid documents required for a rental, such as driving licence, passport, credit card. In such cases, Planet Rentalcars is not obliged to provide the customer with a replacement vehicle. Planet Rentalcars also reserves the right to cancel bookings already confirmed by the customer if the customer is on a ‘blacklist’ maintained by the local car hire provider and the provider will therefore most likely refuse to hand over the vehicle to the customer.
- The customer is obliged to record all signs of use and damage to the vehicle offered that are recognisable to him in a written handover protocol when taking over the vehicle. This is to ensure that the customer cannot be blamed for causing them. If the customer has not recognised a damage or defect or if it only occurs later, the customer is obliged to report this defect to both the car hire provider and Planet Rentalcars without culpable delay (= immediately).
- If the vehicle offered for pick-up by the car hire provider on site does not correspond to the information contained in the customer's booking confirmation and/or if there are actual indications that lead the customer to conclude that the vehicle offered for pick-up is not in a roadworthy condition, the customer is obliged to report his objections without culpable delay (=immediately) both to the car hire provider and to Planet Rentalcars by telephone.
VI. Rental conditions of the vehicle fleet provider
- The offers are aimed at persons with residence in the United Kingdom. Persons/main drivers residing in other countries should inform themselves in advance about the rental conditions of the car hire provider as to whether and under what conditions a rental is possible.
- The customer is obliged to carefully read the General Terms and Conditions and the additional rental contract documents of the car hire provider at the destination and to clarify any questions with the car hire provider at the destination and/or by telephone with Planet Rentalcars customer service before signing the additional rental contract documents of the car hire provider at the destination.
- The general terms and conditions of the car rental provider at the destination, in particular the information on the takeover and return of the vehicle, the security deposit to be paid (deposit) and the costs for accessories to be paid separately on site can be found in a separate information sheet and also become part of the contractual relationship.
- The offers distributed via Planet Rentalcars are based, among other things, on the conditions of the car hire providers. The specified pick-up and return times are therefore binding. A deviating (even premature!) pick-up and/or return of the rental car may result in the booked rate with the car hire provider no longer fulfilling the original conditions (e.g. minimum rental period) and the price of the rental changing. There is generally no refund for unused rental days.
VII. Amount of the deposit, credit card security
- The customer shall provide a financial security (= deposit) for the rental vehicle, the amount of which can be found on the car hire voucher. Unless otherwise agreed in individual cases, the customer must pay the deposit directly to the car hire provider at the destination.
- The customer requires an internationally recognised credit card issued in the name of the main renter of the rental car for the deposit or payment of the deposit. So-called debit cards (such as EC/Maestro, Visa Electron, etc.) are not accepted for the deposit. For some vehicle classes, two credit cards issued in the name of the main driver are required. Please refer to the rental conditions for the relevant vehicle classes. The customer must ensure that the credit card(s) can also be used in the country of car hire. Information on this can be obtained from the credit card company or the bank. Please ensure that you have your personal identification number (PIN) available for the deposit if required.
- Rental without credit card: Selected Planet Rentalcars packages (explicitly labelled ‘No credit card required’) can also be booked without a credit card. For these packages, the deposit can also be paid on site using an UK giro/EC card. In this case, the deposit will be collected from the bank account linked to the debit/credit card when the vehicle is picked up and refunded after the vehicle is returned. The customer must ensure that the bank account has sufficient funds to cover the deposit. Before travelling outside the United Kingdom, Planet Rentalcars recommends that Giro/EC cardholders clarify the functionality of the cards abroad with their home bank.
- Planet Rentalcars will inform the customer of the amount of the deposit to be paid during the online booking process. The deposit depends on the vehicle class and rental company, as well as the rental price and the amount of the excess. In addition, the additional equivalent value of a full tank of petrol and any additional costs to be paid locally for optional services booked by the customer may be included in the deposit amount.
- Which credit cards (Amex, Visa, Mastercard) are accepted as a security deposit is the responsibility of the car hire provider and can be found in their general terms and conditions. It is also at the discretion of the car hire provider to accept credit cards with a validity of less than six months.
- Digital means of payment/credit cards (Apple Pay, Google Pay, etc.) are NOT accepted for the deposit by the local car hire company. The credit card must be presented physically and in the original by the registered main driver when picking up the vehicle.
VIII. Vehicle categories
- The reservation or booking confirmation from Planet Rentalcars applies to the booked vehicle category, not to a specific vehicle model. However, selected Planet Rentalcars packages (with the explicit note ‘Guaranteed vehicle model’) ensure that the reservation or booking confirmation applies to a specific vehicle model (only the colour may differ from the vehicle displayed on the website).
- The local vehicle fleet providers maintain vehicle fleets with different vehicle models of comparable size and equipment. The local car hire provider reserves the right to provide the customer with a vehicle model of equal or higher value. This does not entitle the customer to assert additional claims against Planet Rentalcars, e.g. due to increased petrol consumption.
IX. Included services
- The following services are generally included in the rental contracts concluded between Planet Rentalcars and the customer on the Internet: liability insurance with the amount of cover required by law at the respective destination, fully comprehensive cover (CDW - Collision Damage Waiver, with deductible if applicable), theft protection (TP - Theft Protection), airport taxes and fees, other premium location fees and all local taxes at the time of the booking confirmation issued.
- In addition to the scope in paragraph 1, many of the premium packages offered by Planet Rentalcars include an extended scope of services, such as reimbursement of the excess in the event of damage and reimbursement of the deposit retained by the car hire provider in the event of damage to the glass, roof, tyres and underbody of the vehicle
- For some product packages, this reimbursement is covered by an external insurance benefit. These products are clearly labelled in the offer presentation and booking documents. The conditions for reimbursement of the excess for these products can be found in the insurance conditions enclosed with the product.
- Unless clearly stated in the offer and in the booking documents as an external insurance benefit, the reimbursement of the excess or the deposit retained by the car hire provider is a benefit provided by AurumCars GmbH that is not based on an insurance benefit. The customer bears the risk of recoverability of the claim against Planet Rentalcars and must first make an advance payment.
- If insurance benefits are included in the total price, Planet Rentalcars is the policyholder, and the customer is the insured person. The respective insurance benefits included in the total price will be passed on to the customer at no extra charge.
- The exact scope of the rental contract concluded between Planet Rentalcars, and the customer is already stated during the booking process on the Internet and in the booking confirmation. The maximum amount of cover for damages (excess) can also be found in your booking documents (voucher). If the excess for the vehicle received differs from the booking documents, the excess of the rental contract signed on site applies. This does not affect the maximum amount of cover for the claim sum.
X. Reimbursement of the excess by Planet Rentalcars
- When booking a premium package with reimbursement of the excess by Planet Rentalcars, the customer can subsequently claim reimbursement from Planet Rentalcars in the event of justified damage. This means that the customer does not have to take out any additional insurance with the car hire provider on site. However, experience has shown that many car hire providers require a deposit by credit card (Section VII). In the event of a damage, the car hire provider will withhold the amount of damage from this deposit and the customer must subsequently request reimbursement separately from Planet Rentalcars.
- The following are generally excluded from reimbursement by Planet Rentalcars:
- Damage caused by disregarding the rental conditions of the local car hire provider;
- Damage caused by grossly negligent violation of the local road traffic regulations or criminal offences or damage caused by criminal offences;
- Damage caused by gross negligence or drunk driving;
- Damage to the interior, gearbox, clutch, engine;
- Damage caused by incorrect refuelling and marten bites;
- Damage to glass, roof, tyres and underbody - unless explicitly included in the insurance package;
- Theft, loss or damage to the car keys, vehicle documents or sat nav;
- Consequential costs, e.g. for hotels, telephone, taxi, towing or breakdown service, refuelling and breakdown costs;
- Damage caused by political unrest, war, civil war, civil unrest, riots, strikes, participation in criminal offences, etc;
- Damage caused by force majeure and natural hazards such as weather events (e.g. hail, sandstorms, volcanic eruptions);
- Loss of, damage to or theft of private property from the car;
- Situations in which settlement of the vehicle damage is excluded under the terms and conditions of the motor vehicle insurance policy taken out for the vehicle.
- In the event of a damage, the customer must comply with the following procedure on site:
- Immediately notify the car hire provider's station.
- If a third party is involved in the accident or in the event of theft/vandalism, notify the police immediately so that they can draw up a police report.
- Preparation of a damage report, which must be signed by the car hire provider's station on site when the vehicle is returned.
- The customer must immediately provide Planet Rentalcars with the following documents for the subsequent reimbursement of an excess retained by the car hire provider on site:
- Damage report signed by the rental company;
- Police report (if required);
- Copy of the rental agreement signed with the car hire provider; and
- Proof of payment of the excess to the car hire provider (credit card statement).
- Upon separate request from Planet Rentalcars: Written confirmation from the customer that no proceedings have been initiated against him/her for committing a criminal offence or an administrative offence due to the damage to the vehicle.
- As soon as all the necessary documents have been submitted, Planet Rentalcars will check the requirements for reimbursement and inform the customer of the outcome.
- If the vehicle fleet provider at the destination refunds the customer for previously withheld amounts, in whole or in parts, after Planet Rentalcars has already reimbursed the customer in accordance with the aforementioned regulations, the customer is obliged to promptly return the corresponding amount to Planet Rentalcars without request. The necessary bank details can be obtained from Planet Rentalcars by contacting email@planetrentalcars.com.
- In order to make a claim for reimbursement of the excess, the customer must inform Planet Rentalcars within 180 days of returning the vehicle to the rental company and provide the complete application documents (see also point 4).
XI. Planet Rentalcars money-back guarantee
- Planet Rentalcars offers its customers a money-back guarantee for selected products. When purchasing a Planet Rentalcars product with a money-back guarantee, Planet Rentalcars will refund the customer up to 100% of the purchase price if the customer was not satisfied with one or more aspects of the vehicle hire. The amount of the refund depends on the nature and extent of the reasons for dissatisfaction reported by the customer:
- If the customer was dissatisfied with the pick-up of their rental car (e.g. due to long waiting times, unfriendliness of the counter staff), Planet Rentalcars will refund 20% of the purchase price.
- If the customer was dissatisfied with the car hire itself (e.g. due to the condition or cleanliness of the vehicle), Planet Rentalcars will refund 40% of the purchase price.
- If the customer was dissatisfied with the drop-off of their car hire (e.g. due to long waiting times, poor signage at the station), Planet Rentalcars will refund 20% of the purchase price
- If the customer was dissatisfied with the service provided by Planet Rentalcars (e.g. due to poor availability of the hotline, response time to emails), Planet Rentalcars will refund 20% of the purchase price.
The total amount to be refunded is made up of the sum of all the categories complained about. For example, if the customer was not satisfied with the pick-up and drop-off of their hire car, Planet Rentalcars will refund a total of 40% of the purchase price (20% each for pick-up and drop-off).
To claim the money-back guarantee, the customer must submit the categories and reasons for their dissatisfaction to Planet Rentalcars by email or via an online application form. For direct bookings via Planet Rentalcars, the money-back guarantee is submitted by e-mail.
- Conditions for claiming the money-back guarantee:
- The money-back guarantee claim must be reported to Planet Rentalcars Customer Service within four weeks of dropping off the rental car.
- The customer must complete all required fields of the claim form conscientiously and truthfully.
- The money-back guarantee only covers the purchase price paid to Planet Rentalcars eat the time of booking. All fees to be paid directly to the rental company at the time of pick-up (e.g. for additional extras, one-way rentals, additional drivers, border crossings, damage repairs) are excluded from the money-back guarantee.
- Also excluded from the refund are complaints that are due to a disregard of the rental conditions (e.g. non-receipt of the vehicle/longer waiting time due to missing driving licence, insufficient deposit on the credit card, etc.).
- Canceled bookings are not eligible for the Planet Rentalcars money-back guarantee.
XII. Minimum age, driving license
- The customer is solely responsible for checking and ensuring that the driver has reached the minimum age required to drive the selected vehicle category at the selected destination(s). In most countries this age is between 21-25 years, but for some vehicle categories it may be higher. In some cases, the minimum age can be reduced for an additional fee. In addition, a maximum age applies in some destination countries. The specific requirements for the minimum or maximum age of the driver can be found in the rental conditions of the respective booking, which are displayed to the customer during the booking process.
- All drivers of a rental vehicle must be in possession of a Class III driving licence (Euro driving licence B) that has been valid for at least 1 year (in some countries up to 3 years) and shows which vehicle categories the holder is authorised to drive. The driving licence must be issued in Latin characters. Otherwise, an international driving licence is also required. For rentals outside the EU, we generally recommend taking an international driving licence with you. Without an international driving licence, the local rental company may refuse to hand over the rental car under certain circumstances. The exact requirements can be found in the rental conditions of the local rental company. The original driving licence must be presented together with a valid passport or identity card when picking up the vehicle (see section V).
XIII. Rental of optional extras, additional driver
- If the customer wishes to hire a vehicle with optional extras (e.g. child seats, navigation system, winter tyres, etc.), they must request the desired optional extras at the time of booking. If the customer is not expressly shown the desired optional extras as part of the stated booking price, the prices and fees for the optional extras requested by the customer are not yet included in the booking price and the associated services are not part of the rental contract between the customer and Planet Rentalcars, but must be paid separately on site to the rental company.
- The customer is asked to note that the safety standard of child seats provided by the car hire providers is based on the usual local standards. We therefore recommend - if possible - taking your own child seats with you.
- Costs for additional drivers are not included in the rental price, unless the customer has specified the additional driver(s) as part of the booking and received a corresponding booking confirmation or the rental conditions of the local rental company exceptionally do not provide for an additional charge for additional drivers. In any case, the customer is obliged to enter all additional drivers in the additional rental contract documents of the local rental provider. All additional drivers to be registered must be present at the time of vehicle handover (see section V) and be able to present their driving licence and passport or identity card.
- Rental companies may also offer the winter equipment (winter tyres) with all-season or all-weather tyres. This applies if the tyres are marked M+S for ‘mud and snow’.
XIV. Refuelling regulations
The applicable refuelling regulations are displayed to the customer during the booking process and are also described in the rental conditions provided by the rental company on site. The customer must observe the local rules and conditions of the car hire provider with regard to the pick-up and return of the vehicle (the regulations in Section VI Para. 1 apply to the clarification of questions before signing a contract).
XV. One-way rentals, border traffic
- One-way rentals are often associated with additional charges for the customer and must be requested by the customer during the booking process and need to be confirmed by Planet Rentalcars. One-way rentals may not be bookable for all vehicle classes and/or between all stations of a car hire provider. Bookable one-way rentals may be subject to further restrictions (e.g. minimum rental period), which the customer must observe.
- Departure from the country in which the vehicle is rented to other countries requires the authorisation of the rental company and must be requested at the time of booking. Additional fees may have to be paid for this, or specific restrictions may have to be taken into account. Ferry journeys are generally not permitted by most rental companies.
XVI. Rebooking
- AurumCars GmbH does not charge any fees for rebookings or subsequent changes to the rental contract concluded via the Internet, e.g. with regard to pick-up time, duration or location of the rental, vehicle class, etc., if these are requested from Planet Rentalcars up to 48 hours before the originally planned pick-up date. However, rebookings and/or subsequent changes to the booking are subject to availability with the rental company and may therefore result in an increase in the rental price. Booking changes must be made via AurumCars GmbH. Changes/rebookings must be requested by the customer in good time and confirmed by AurumCars GmbH. If this confirmation is not provided, the customer alone must bear the consequences, e.g. further payment claims by the car hire provider.
- If the customer returns the rental car to the rental company late, the customer shall bear the resulting charges for the duration of the delay. These are based on the local tariffs and conditions of the rental comany and are to be paid directly to the latter.
XVII. Right of revocation/cancellation conditions
- A revocation or cancellation of the confirmed booking is possible for the customer free of charge if his declaration is received by Planet Rentalcars at least 24 hours before the start of the rental in text form (e.g. by e-mail to email@planetrentalcars.com) and it is not a separately marked ‘non-cancellable’ offer. Cancellations made by the customer to the rental company on site will not be accepted and will not be forwarded to Planet Rentalcars.
- If the cancellation is received less than 24 hours before the start of the rental, the customer can effectively withdraw, but must pay Planet Rentalcars compensation in the amount of the full sales price. Consequently, the customer must bear the full costs in the case of so-called short-term cancellations and will not receive a refund.
- If the customer's declaration is received by Planet Rentalcars after the time in paragraph 1 or if the customer does not appear to pick up the vehicle (subject to the exception in section 5 paragraph 2 of these GTC or other termination or cancellation of the contract), Planet Rentalcars will charge the customer the full rental price. The customer is entitled to prove that Planet Rentalcars has incurred no or less damage. Planet Rentalcars reserves the right to claim higher damages.
- The regulation of § 580a BGB does not apply to the contract between Planet Rentalcars and the customer.
- Planet Rentalcars will not refund any rental days already paid for but unused according to the voucher after the contract with the rental company has been opened if the rental vehicle is returned early.

How are the search results sorted?
On the search results page, the sorting of the results list by 'popularity' (ascending by popularity based on the bookings and ratings of our customers) is usually preset and displayed accordingly. Customers can also choose between sorting by ‘Lowest price’ (ascending by asking price), ‘Highest rating’ (descending by highest score from 1 - 10) or ‘Best customer rating’ (descending by stars awarded to the rental company by customers from 1 - 5).The sorting by popularity is based on the bookings and ratings of our customers as well as the attractiveness of the prices. To do this, we collect anonymised data, which is then evaluated by an algorithm (a self-learning system). The algorithm compares the key parameters of offers such as price, car rental company, customer ratings, insurance cover, free kilometres, refuelling regulations, including extras such as additional drivers and quality of content (e.g. photos) with the reaction of customers (e.g. which offers are clicked on, which are booked). From the many, very different reactions in the past (e.g. customers mainly buy products with very good ratings or favourable prices), the algorithm learns how the individual parameters of an offer must be weighted in order to assess the popularity of an offer.
Why are filters used for some searches?
In some countries, there are rental companies with poor customer ratings (less than 3 out of 5 stars) and offers with unfair refuelling regulations. An unfair refuelling policy exists, among other things, when customers cannot pick up and return the rental car with a full or identically filled tank, but when the rental company carries out the refuelling and collects significantly higher fuel costs for this.In order to protect customers from potentially bad experiences with the local car hire company, Planet Rentalcars uses the threefilters: 'good customer ratings' (i.e. more than 3 out of 5 stars from our customers for the car hire company), ‘fair refuelling policy’ (i.e. ‘full/full’ or ‘same/equal’) and the exclusion of non-refundable offers on the search results page in selected countries.Pre-filtering is carried out transparently by selecting the relevant filters and a corresponding note is also displayed above the list of results. This notice also contains the most favourable price for offers with poor customer ratings or unfair tank regulations.
In addition, for short-term searches with a desired collection within the next 48 hours, the filter 'immediately available' is placed in front.
In contrast to offers that are 'on request', immediately available offers do not have to be reconfirmed by the car rental company after booking. By pre-filtering immediately available offers, Planet Rentalcars thus ensures that customers with a short-term car hire requirement are sure to receive the desired offer and are not negatively surprised by a cancellation from the car rental company shortly before the desired pick-up time and have to make a replacement booking, which is usually more expensive.
All pre-set filters can be easily cancelled by deselecting the active filters or by clicking on the pre-filtering notice.
How is the price of the offers calculated?
The combination of the selected services, such as a hire car service and an insurance service, results in the rental price shown. Due to the real-time checking and compilation of the services, there may be short-term rental price changes in the display on a daily basis.
Where do the customer reviews come from and are they genuine?
The displayed rating comes from real customer reviews directly from Planet Rentalcars, Aurum Cars GmbH and from our partner CHECK24 Mietwagen Vergleichsportal GmbH and is labelled as such. - 5.2. Note on the restriction of user-created content
- 5.2.1. Users who have made a car hire booking can leave reviews. Ideally, all reviews are published, regardless of whether they are positive or negative. In order to avoid fraud and to ensure that user content does not contain the following,

- Insults, threats, glorification of violence, obscenity/pornography, advertising and discrimination such as racism, homophobia, sexism, political, ethical or religious statements
- Planet Rentalcars implements measures for checking. Under certain circumstances, corrective measures (e.g. removal of the content) may be taken. This involves a review by trained employees.
- In addition, users can also report content themselves to email@planetrentalcars.com if, in their opinion, it violates the law or AurumCars GmbH's terms and conditions. The reports are checked and, if necessary, corrective measures (e.g. removal of the content) are taken.
- 5.2.2. Users affected by decisions of the notification & redress procedure pursuant to Art. 16 of the Digital Service Act may complain by e-mail to email@planetrentalcars.com up to 6 months after the decision. If a decision by Planet Rentalcars is affected, Planet Rentalcars will review the original facts and the decision taken. Complainants will immediately receive a reasoned notification of the outcome of the complaints procedure.

XIX. Liability
- Claims for damages by the customer against Planet Rentalcars are excluded. Excluded from this exclusion of liability are claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages based on an intentional or grossly negligent breach of duty by Planet Rentalcars or its vicarious agents. Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely.
- In the event of a material breach of contractual obligations, Planet Rentalcars is only liable for foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer's claims for damages are based on injury to life, limb or health.
- With the exception of claims in tort, claims for damages for which liability is limited in accordance with this section "Liability" expire after one year. Planet Rentalcars ' liability under mandatory statutory liability regulations remains unaffected by the above limitations and exclusions of liability.
- To the extent that Planet Rentalcars ' liability is excluded or limited, this also applies to the liability of Planet Rentalcars ' employees, workers, staff, representatives and vicarious agents
XX. Final provisions
- All legal relationships between Planet Rentalcars and the customer are subject exclusively to the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB), sentence 1 only applies insofar as the choice of law does not undermine the protection of mandatory legal provisions of the country in which the customer has their habitual residence.
- In the event that the customer has their place of residence or habitual abode outside the Federal Republic of Germany, or if this is unknown at the time the action is brought, Munich is agreed as the exclusive place of jurisdiction for the assertion of claims by AurumCars GmbH against the customer, provided that this does not affect the mandatory consumer protection rights under the laws of the consumer's country of residence, specifically the United Kingdom, if applicable.
- Should individual provisions be wholly or partially invalid or unenforceable, or should they subsequently lose their legal validity or enforceability, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provisions shall be replaced by the statutory provisions.
- Amendments or additions to the rental agreement must be made in writing or text form. The written form is required for the amendment, cancellation or supplementation of this clause.
